As a well-being guide, MUSE does not provide healthcare, medical, or nutritional therapy services or diagnose, treat, prevent, or cure any physical, mental, or emotional issue. The role of a Wellness Guide in this healing process is to consider the client as a whole person and to consult with the client concerning changes in lifestyle, diet and supplementation of herbs and/or vitamins to foster an increased state of balance and health. As a collaborative part of your care team, please inform your healthcare providers of any new protocols you are considering.
Release and Waiver of Liability
Effective immediately upon execution, I do hereby release and forever discharge Muse Ancestral Wellness [MUSE], their agents, employees, successors and assigns, and their respective heirs, personal representatives, affiliates, successors and assigns, and any and all persons, firms or corporations liable or who might be claimed to be liable, whether or not herein named, from any and all costs, claims, causes of action and damages arising from any and all illness or injury, or death to my person, that may result from or occur as a result of my participation in the Health Coaching Services, whether caused by negligence or otherwise.
I accept that the ultimate responsibility for my health care is my own and that MUSE is here to provide support. I understand that MUSE reserves the right to determine which cases fall outside their scope of practice, and offer an appropriate recommendation where possible. I hereby agree to assume full responsibility for any manner of loss, injury, claim or damage whatsoever, known or unknown, incurred as a result of same and I, my heirs, executors, administrators or assigns for any loss, injury, claim or damage sustained as a result of my attendance and/or participation. I have read the above release and waiver of liability, and fully understand its contents and voluntarily agree to the terms and conditions stated
By purchasing Muse Course or any Muse educational products, I agree that I have carefully read and fully understand this MUSE’s policies and practices and I am freely, knowingly and voluntarily agreeing to the terms of the below release.
Indemnification
The purpose of ancestral wellness guidance is to provide information to improve nutrition and lifestyle through the use of education, historical practices, tools and food to improve overall health and well-being. Muse Ancestral Wellness [MUSE], does not diagnose, treat, cure, or prevent any diseases, disorders or conditions.
MUSE is not a licensed Coach, Nutritionist, Dietitian or Medical Physician. The information provided in MUSE’s programs/services is for informational purposes only and is not a substitute for professional medical advice, diagnoses, or treatment. Always seek advice from your physician or other qualified healthcare provider before undertaking a new health regimen.
I understand that coaching is, at present, an unregulated industry and that MUSE is not certified or licensed by the State of Georgia.
I will not disregard medical advice or delay seeking medical advice because of information received from MUSE’s programs/services. I will not start or stop any medications without speaking to my medical or mental health provider.
Confidentiality
This Privacy Policy governs the manner in which the website and/or Muse Ancestral Wellness [MUSE] practitioners collect, use, maintain and disclose information collected from members and users of the website. This privacy policy applies to the musewellness.club website and all products and services offered by MUSE.
As part of MUSE’s Ancestral Wellness coaching services, I may be asked to provide information concerning my lifestyle, medical history, physical habits, moods, energy levels, preferences, and diet, etc. This information is collected to enable MUSE to: (i) provide individualized recommendations, (ii) educate me about nutritional and lifestyle tools and practices that are applicable to my specific circumstance and (iii) recommend holistic lifestyle changes to improve my general health, vitality and overall well-being. MUSE will keep this information confidential and will not release or disclose this information to any individual/third-party outside of the MUSE framework, without my prior consent, except as required by applicable law.
MUSE will only use members personal information for the following purposes:
To improve MUSE services and/or customer experience
To send periodic emails as it pertains to your account, purchase, program, MUSE services and/or marketing. Users will always have the option to opt out of receiving any/all emails using the unsubscribe instructions or by contacting MUSE directly.
In the course of using MUSE services I may need to access links to websites and services that are owned or operated by third parties, (e.g. google, squarespace etc). Any information I provide on or to a Third Party Service or that is collected by a Third Party Service is provided directly to the owner or operator of the Third Party Service and is subject to the owner’s or operator’s privacy policy. MUSE not responsible for the content, privacy, or security practices and policies of any Third Party Service. To protect my information MUSE recommend that I carefully review the privacy policies of all Third Party Service(s) that I access.
I understand that the use of technology is not always secure and I accept the risks of confidentiality in the use of email, text, phone, Zoom, Google meet and other technology.
MUSE does not sell, trade, or rent members personal information.
Awareness & Assumption of Risks
If Ancestral Wellness [MUSE] suspects the existence of disease, disorder or condition, I will be informed of this suspicion. However, I acknowledge this is not a diagnosis or conclusion about the state of my health and that I should promptly consult a licensed Physician or other health professional about any suspected problems.
I understand that MUSE programs and services are not a substitute for professional mental health care, medical care, counseling, psychotherapy, psychoanalysis, or substance abuse treatment and are not intended to diagnose, treat or cure any mental health or medical conditions. I also understand that MUSE is not acting as a mental health counselor or a medical professional and I will not use it in place of any form of therapy.
I understand and agree that I am fully responsible for my well-being, including my choices and decisions, pre, post and during my coaching sessions.
I understand that all comments and ideas offered by MUSE are solely for the purpose of aiding me in achieving my defined goals. I have the ability to give my informed consent, and hereby give such consent to MUSE to assist me in achieving such goals.
I understand that to the extent our work together involves health and wellbeing, MUSE is not promising outcomes, included but not limited to increased weight loss, rehabilitation and/or cured disease(s).
MUSE is in no way liable for my health or safety and is reliant upon me providing the complete, truthful and accurate information to properly inform any recommendations such as changes to lifestyle and diet, including the use of nutritional supplements. Any and all changes are entirely my responsibility to investigate to implement into my healthcare.
Payment, Refund and Cancellation Policy
By signing this Agreement, I understand that I shall be the party responsible for the payment of fees, dues and any other charges payable to Ciera Tavana/Sofia XIV dba “Muse Ancestral Wellness” [MUSE]. I understand I must provide timely notification to MUSE of any changes to address, phone, e-mail, scheduling or payment.
I understand that all of the following apply to any service provided by MUSE, including but not limited to group or individual Wellness Coaching Sessions and Program Plans:
Payment: All applicable packages and purchases must be paid in full via debit or credit card before session(s) can begin. Packages are non-transferable and non-refundable. If the package is semi-private or group, the listed price is per person.
For programs with payment plans, any early cancellation of balance payment will result in a 25% cancellation fee. The deposit payment is non-refundable. This is to cover the time and work put into the initial consultation, evaluation and/or creation of your custom assessment plan.
MUSE is a direct wellness support service; it is not health insurance. MUSE does not participate with or bill commercial health insurance plans or federal healthcare programs such as Medicare or Medicaid. MUSE practitioners may recommend you receive services not offered by MUSE (e.g., specialty services, diagnostic tests), but in no event will MUSE be responsible for any resulting medical bills.
Appointment Cancellations: Must be done at least 48 hours before the appointment starts, or you will forfeit the appointment. Three “no-shows” or consecutive "rescheduled" will cancel your session/program. Any exceptions must solely be at the discretion of MUSE.
You must notify Muse of cancellation or rescheduling of an appointment via email or text 48 hours before your appointment time starts.
You will forfeit your session if it is canceled with less than 48 hours' notice. Under certain circumstances, 24 hours or less will be considered; however, this is NOT guaranteed. This policy is to ensure efficient scheduling for all clients.
Packages: All Programs are offered for a mutually agreed upon time frame. See specific Program for quantity of sessions and completion timelines. Any program that is purchased is for that assessment type only, and can only be transferred to another program type, or redeemed for a different service with MUSE's direct review and approval.
Cancellation of Service. To cancel a service package, Customer must provide a written 14-day notice of cancellation. Until notice of cancellation is received by us, and cancellation is finalized, service will continue and Customer will remain responsible for paying for said service or services. Service Termination. Upon expiration of Customer-provided notice of cancellation, services will terminate immediately.
Early Cancellation. Customer may cancel this agreement without penalty prior to commencement of service by providing written notice at least 14 days before the first scheduled service (ie. intake form and/or initial session) will take place. Intake forms are the first step in the assessment process. Once an intake form has been completed and submitted MUSE initiates work on a client’s specific individualized program in preparation for the first 1:1 session(s).
Cancellation Fee. Service provider does not charge an additional cancellation fee for services terminated prior to the 14 day early cancellation window.
Provider Initiated Cancellation. We reserve the right to cancel service if the Customer's account remains delinquent for 7 days after the Customer is notified that the account has become delinquent.
If fees are not collected within 7 days, all program sessions will be paused and MUSE will notify the Client via phone call and/or e-mail.
Intellectual Property
All documents or other materials developed or created by Muse Ancestral Wellness [Muse] or any other person engaged directly by MUSE to perform the services required hereunder shall be and remain the property of MUSE without restriction or limitation upon their use.
Severability
I acknowledge that this Waiver is reasonable, valid and enforceable. I acknowledge that this Agreement has been read and I fully understand the provisions of this Waiver.
Updates
I understand that MUSE may change its policies from time to time and will give reasonable notice of any material change.
